Government releases planned consultation and implementation timelines for the upcoming Housing Legislation (Building Better Futures) Amendment Act 2017 changes

The Department of Housing and Public Works has recently announced its plans for further consultation plus the expected implementation and consultation timelines for the changes required as a result of the Housing Legislation (Building Better Futures) Amendment Act 2017. Changes will be made to a number of Acts including manufactured homes and retirement villages.

The Department’s plans are set out in a timeline, which can be viewed here. 

Relevantly, the Department’s plans involve the following stages:

Manufactured Homes (Residential Parks) Act 2003

  • Stage 1 - dispute resolution, site rent, utilities, park liaison and visitor access:
    • Consultation - May and June 2018
    • Implementation - August, September and October 2018
  • Stage 2 - pre-contractual disclosure, cooling off period, emergency plans:
    • Consultation - September, October, November and December 2018
    • Implementation - April, May and June 2019

Retirement Villages Act 1999

  • Stage 1 - pre-contractual disclosure, access to documents, reinstatement of unit:
    • Consultation - May and June 2018
    • Implementation - August, September and October 2018
  • Stage 2 - change in village operations, retirement village contracts:
    • Consultation - October, November and December 2018
    • Implementation - April, May and June 2019
  • Stage 3 - standard financial reports and budgets
    • Consultation - April, May, June, July and August 2019
