Reminder - final stage of manufactured homes amendments to commence on 1 September 2019

Park owners should now be aware from our previous articles, that the final stage of amendments to the Manufactured Homes (Residential Parks) Act 2003 (Qld) (Act) will commence on 1 September 2019.  

These amendments include:

  • the new disclosure requirements for entry into site agreements (initial disclosure documents at least 21 days prior and supplementary disclosure documents at least 14 days prior); 
  • the ability to obtain a waiver to reduce the above timeframes to seven days; 
  • new cooling off periods - including a minimum seven day cooling off period from when the last person signs the site agreement (even where the disclosure process is complied with); 
  • new disclosure processes for assignments; and
  • the requirement to have in place an emergency plan for the park.  

This means that on 1 September 2019, park owners will need to be ready to comply with the new procedures and ensure that an emergency plan for the park is in place. New approved forms will also be published and must be used from 1 September 2019.
